Work highlights

  • Acting for Equustek Solutions Inc. in ongoing proceedings related to the Supreme Court of Canada ruling in Google v. Equustek (2017 SCC 34). The trial judgment was increased to $11 million in October 2021 (2021 BCSC 2126), and we are now scheduling the hearing for the application to determine whether the global take-down orders against Google should be made permanent, expected in late 2022.
  • Acting for multiple parties of Chinese origin where there is an issue related to the source of the funds – coming from China – related to the Canadian property in dispute, and the difficulty in obtaining records of the source of those funds in an environment where persons of Chinese origin may face restrictions getting lawful assets out of China.

Robert Fleming Lawyers is a Vancouver litigation boutique focused on the resolution of complex business disputes. Founded in 2008, the firm’s practice is wide ranging, with an emphasis on fraud claims, shareholder or partnership disputes, and international asset recovery.

RFL’s work is innovative and often on the leading edge of the law. Fleming was counsel on Google v Equustek (2017 SCC 34), the leading case in the world on the court’s ability to control global content on the internet. He regularly appears on Mareva (asset freeze) and Anton Piller (civil search warrant) applications, and recently argued the first ever ex parte appeal in the BC Court of Appeal – on a worldwide Mareva injunction with parallel asset freezing proceedings in France

RFL combines creativity with analytical discipline, and emphasizes collaboration with clients. The team builds an economic model for every case, to find the right balance of risk, reward and cost.
