We deal with all aspects of an insured’s claim from the initial stage of advising on when and how to notify insurers, including notifications made on a “block” basis. We take every opportunity to provide discrete claims advocacy and promote pre-action mediation with a view to avoiding escalation to a formal dispute.

If a dispute is unavoidable then we have the necessary experience in all the usual forms of dispute resolution procedure. Wynterhill regularly handles insurance litigation in the Commercial Court and has represented clients before the Court of the Appeal. Likewise, our team is experienced in handling most forms of arbitration prescribed by insurance contracts.  

Each claim is different and we recognise the need for a bespoke strategy which can adapt to changes in the issues or commercial circumstances while always being alive to opportunities to adopt an innovative approach. Consequently, we have resolved many disputes by way of expert determination, other forms of ADR, and short form arbitrations that resolve narrow issues promptly.

We have close working relationships with London’s specialist insurance barristers’ chambers and other experts in the market; and are able to assemble the right team to take on any case.

Finally, we believe strongly in holding insurers to account for poor claims handling and have been successful with many ‘s.13A’ claims despite the absence of a successful case in the Courts.
