Carter Perry Bailey LLP (CPB) is one of the leading boutique insurance and reinsurance practices in the UK and the international market. Expertise includes reinsurance, insurance claims and coverage, insurance defence, commercial and regulatory advice drafting and transactional work. The firm has represented UK and international insurers and reinsurers, Lloyd’s syndicates, brokers, agents, run-off managers and others involved in insurance and reinsurance transactions and disputes. CPB is experienced in advising on international insurance and reinsurance disputes and acting in international litigation and arbitration. CPB also acts in international commercial disputes, including international arbitration, and in trust and fiduciary disputes.

CPB’s is also active in other international legal organisations, including the International Association of Defense Counsel (of which Bill Perry is a past president), the Federation of Defense and Corporate Counsel (of which Stephen Carter has been chair of the reinsurance section, vice chair of the international section and UK country representative), British Institute of International and Comparative Law and the Chartered Institute of Arbitrators. Stephen Carter and Bill Perry are Members of the Chartered Institute of Arbitrators and Stephen is an ARIAS UK arbitrator. Types of work undertaken
Insurance and reinsurance contentious: CPB acts in insurance and reinsurance disputes, including complex international litigation and arbitration. In reinsurance CPB acts in proportional and non-proportional risks, both facultative and treaty. Insurance coverage involves a wide variety of classes of business, including property/casualty, professional indemnity, D&O, BBB, credit, cyber, business interruption, fine art and specie, marine, general aviation, contingency, EL, PL and life and health. Insurance defence work includes a range of business areas, such as professional and financial risks, public liability, industrial injury and fine art.
Professional and financial liability: expertise includes solicitors, barristers, brokers, property agents, surveyors, valuers, accountants, directors and officers, banks, financial advisors, insurance professionals, construction professionals, trustees and executors, dentists, galleries and auction houses.
Insurance and reinsurance non-contentious: CPB’s non-contentious work includes advising on the establishment of brokers and insurers in the UK, drafting insurance/reinsurance documentation (including ART/ILS-related), agency agreements, advice on FSMA 2000 Part VII transfers of business and run-off issues, regulatory advice and representation, sales and purchases of companies, brokers and portfolios, as well as in other transactional matters including warranty and indemnity provisions in corporate M&A work. CPB has also been instructed to assist corporate law firms in relation to the specialist insurance aspects of transactions that they act in.
Trust and fiduciary disputes: this work can involve the breakdown of relationships between family members, beneficiaries, trustees and advisers, often with large sums at stake and multi-jurisdictional involvements. Expertise ranges from issues of mental capacity to execute wills to international disputes involving the suitability of complex debt instruments as trust investments and proper administration of extensive international trust assets.
Trade and commerce: CPB also acts for domestic and overseas corporations in international commercial arbitration and commercial litigation.
