Naomi Hoare

Naomi Hoare

Naomi Hoare is a Solicitor & Partner (appointed 1st July 2025) in our Exeter office. Qualifying in 2011, Naomi is a full member of the Society of Trusts and Estate Practitioners ('STEP'), as well as being one of the Directors of the firm’s trust corporation. Naomi advises a range of clients, including individuals, farmers, personal representatives and trustees, routinely providing in depth and comprehensive tax advice and succession planning for clients and their families. Naomi is also involved in preparing complex tax relief claims in the administration of high value estates, helping the team maintain its 100% success rate with Business Property Relief claims. Due to the increasing complexity of the work the team has undertaken over the past year, Naomi has had regular cause to work collaboratively with other teams at Tozers and has been responsible for reporting directly to the senior managers and compliance officer in respect of complex transactions being undertaken by Tozers Trust Corporation Limited. Naomi continues to play an important and active role in assisting junior members of the team to build their confidence and legal knowledge, as well as often being a port of call for other teams at Tozers, using her extensive knowledge to answer queries for colleagues on their files which relate to Naomi’s areas of expertise. Naomi is a student member of the Chartered Institute of Taxation and is working towards Chartered Tax Adviser status, having identified that the team and firm would benefit from having additional expertise in this area, particularly with regard to how corporate and personal taxation overlap.   With considerable post-qualified experience, Naomi enjoys rising to the challenge of technically demanding work but always places her client relationships at the centre of the matter, taking time to get to know the people behind the instructions and understand their priorities in order to achieve the desired result. Naomi’s notable, recent work (outside the case summaries below) includes: Obtaining a grant of probate where the deceased had a validly executed a Codicil, but the Will it amended had not been signed. Naomi managed to successfully argue that the unsigned Will had been incorporated into the Codicil and was therefore admissible to probate. The success of this application was notable because the Codicil actually referred to the Will bearing a particular date, which was not the case as it had not been signed. However, Naomi was able to navigate the requirements under the Non-Contentious Probate Rules to demonstrate, on the balance of probabilities, a Will bearing the cited date had never existed. Therefore, she presented evidence that the inclusion of the date had to be an error and the only document to which the Codicil could have referred was the unsigned Will. The success of this application meant a lot to the family making the application, as they knew the deceased had believed he had a valid Will and Codicil in place. The preparation and submission of an Inheritance Tax account incorporating a claim to Business Property Relief in respect of a boatyard business. This was a challenging claim because in the relevant years leading up to the date of death, the established patterns and income streams of the business had temporarily altered due to changes during and immediately after the pandemic. This meant that over the specific period of review for HMRC purposes, something of an anomaly in the wider context of the business’s history had taken place. Naomi carried out a deep dive and presented a case to HMRC which demonstrated that the relevant period was not reflective of the broader picture relating to the business. The claim was accepted by HMRC without any queries raised. Progressing an estate where the deceased died with assets in France and the UK, but where the UK Will excluded the French assets. Naomi has worked with the French lawyers to determine which jurisdiction governs the succession of the deceased’s French estate, leading to Naomi acting in the preparation, translation and obtaining the Apostille on an affidavit of applicability of foreign law for use in France. Naomi has acted for the executors and trustees in the administration of an agricultural estate which left in discretionary trust. The memorandum of wishes guiding the trust requested that the title covering the bulk of the land and farmhouse was split, giving the farmhouse to one group of beneficiaries and the land to another. Naomi has worked closely with the property team, the surveyor who valued the estate and the beneficiaries to try to oversee the splitting of the title; something made more challenging by the fact that the beneficiaries have fallen out with each other.

Gráinne leads on the highest-value and most complex cases dealt with by the team, assisted by team members from Partner level down.    Gráinne routinely advises holiday and residential park owners on their complex succession planning needs, dovetailing documents such as Wills, trusts and deeds with their business and family situation, while providing clear and thorough advice on their Inheritance Tax position. Business Property Relief for park owners is an often-misunderstood area of Inheritance Tax law with many legal advisors and accountants misinterpreting or misapplying the Inheritance Tax rules and associated case-law.  Owners of residential parks, in particular, are often professionally advised that it is impossible for them to secure Business Property Relief from Inheritance Tax due to the potential characterisation of their businesses as ‘making or holding investments’ which is prohibited by s 105(3) IHTA.  Under Gráinne’s leadership, Tozers Wealth Management Team have consistently secured business property relief for residential park owners, as well as for holiday park owners, and advise residential and holiday park owners, as well as those managing hybrid businesses, in relation to their personal Inheritance Tax position or act for them in claiming relief on death.  Gráinne is often approached by mobile home and holiday park owners who have needed to change advisors, or seek additional legal support, to take appropriate advice in relation to their Inheritance Tax positions and succession planning. As a trusted advisor with countless years’ experience in advising park-owners, Gráinne routinely tackles all forms of succession planning for her clients, including Wills, trusts and practical suggestions.
