It was argued that this fell within the legacy gift to her brother, and a claim under The Inheritance (Provision for Family and Dependants) Act 1975 for financial provision from the estate of her late mother who died in July 2016.
  • Acted for a client, who was the illegitimate daughter of a deceased individual, who had left a will leaving his estate to his children (no children were named in the will). Her client’s paternity was challenged. The executor lives in Australia.
  • Instructed on behalf of a child of a deceased individual to defend a 1975 Act claim against the estate of her father who committed suicide.
  • Acted for the beneficiaries of the estate to defend a claim brought under The Inheritance (Provision for Family and Dependants) Act 1975 for financial provision by the Deceased’s step daughter.
  • Acted for a client in an extremely emotional case concerning the suicide of the client’s late husband. The couple lived in a property which they themselves had constructed, which occupied farmland owned by others. Whilst Katie Latham’s client was the beneficiary of her husband’s estate under the intestacy rules, there was a dispute concerning whether there was any right for the property to sit on that land.
