Career

Nicholas Marler is a 10+ year PQE solicitor and former private practice dispute resolution lawyer. He has been with Litica since 2021, and prior to that spent four years working at Harbour Litigation Funding where he negotiated, executed, and managed investments worth hundreds of millions of pounds and established a bespoke adverse costs insurance facility through which tens of millions of pounds of cover was purchased. He is one of a vanishingly small number of people to have years of experience working in each of private practice, litigation funding and adverse costs insurance, providing him with a uniquely holistic perspective.

As Litica’s principal UK underwriter, Nicholas is responsible for underwriting a wide array of complex legal risks – both individual and on a portfolio basis - across various sectors, industries and jurisdictions. He plays a central role in almost every single every medium and large UK risk in which Litica participates; at the time of writing this exceeds £2.5bn by aggregate limit of indemnity. This far exceeds the aggregate limits written by Litica’s competitors.

He is adept at drafting and negotiating complex policy wordings and other contractual documentation required to paper deals, with various co-insurers routinely following his lead on documentation.

Alongside his core adverse costs insurance practice, Nicholas also deals in contingent risk and portfolio capital protection insurance:

In 2022, he played a leading role in Project Brick - the provision of a EUR €270m capital protection insurance policy to a major litigation funder. 2024 saw him provide a GBP £107m policy to a prominent claimant law firm, whilst in 2025 he provided a £77m policy to another litigation funder and a further £29m in associated adverse costs insurance to enable a suite of environmental litigation to be brought. At the opening of 2026 he is about to close a £140m capital protection insurance policy in order to unlock funding for a raft of competition litigation.
