Position
Oscar Smith is a Partner at Expatriate Law, advising on all issues arising from the breakdown of a relationship, whether between married or unmarried couples.
He is a specialist international family lawyer regularly instructed on complex cross-border children and financial matters. His experience spans cases from across the globe, particularly involving Europe, the Middle East and Australia.
He has developed a particular reputation for technically demanding cases involving jurisdiction battles, offshore trusts, international relocation, parental responsibility, and matters where the welfare of children intersects with novel jurisdictional questions. Oscar is a Resolution-accredited specialist in complex high-net-worth financial remedies and cohabitation cases. He is also a collaboratively trained lawyer.
Career
Oscar joined Expatriate Law in May 2021 as a Senior Associate and was promoted to Partner in 2026. He qualified in 2015 at Russell-Cooke LLP.
Oscar has been involved in two recent reported decisions: M v F (Parental Responsibility) [2024] EWFC 377, which clarified the treatment of birth certificate errors in parental responsibility proceedings, and G v H (Relocation to Australia) [2024] EWFC 230, in which he successfully obtained permission for an autistic child and his mother to relocate from England to Australia.
Co-authored an article published in Resolution’s The Review and is a regular contributor to the firm’s thought leadership and publication programme, as well as a speaker at external events and conferences.
