Vinatea & Toyama restarted its activities in September 2019, after almost 20 years of having been part and having developed the labour department of Miranda & Amado. During that period, the area was positioned as the most powerful in the local market.

Vinatea & Toyama has 36 lawyers, including 7 partners, and provides counsel on labour relations, labour consultancy, labour dispute settlement, arbitration and litigation, collective bargaining, and migration. The diversity and complexity of the cases in which they intervene, as well as the profile of their clients and their presence in practically all sectors of the Peruvian economy, has placed the firm as the undisputed market leader.

The firm has decided to privilege: (i) A technological approach, which consists in developing a digital culture across the team and focuses its attention on the client; (ii) The flexibility and efficiency of its service delivery, which includes professionals from different specialties, and; (iii) Its vision of regional expansion, which leads it to offer labour solutions at local and regional level. In September 2020, during the Covid-19 pandemic, the firm launched Vinatea & Toyama Courses, an online educational platform that aims to democratize labour legal education in Peru, through low-cost short courses. In September 2021, the Ministry of Labor published “Agenda 19” which includes initiatives to provide more protection to the workers. Its content has been challenged by many sectors because it did not include proposals to reduce informality, maybe one of the most important Peruvian labor market problems. However, the current year has been guided by such Agenda and many of its proposals have come true.

One of the main changes was the modification of the Outsourcing Law, which forbids outsourcing of core business activities. Although various companies and employers’ organizations are questioning its constitutional validity, the changes are already being applied.

The Collective Labor Relations Law also has been changed, creating new union types, forbidding the extension of collective agreements to non-unionized workers, and prohibiting employers to start labor arbitrations, among others.

Also, as it was proposed in the Agenda, a preliminary draft of the Labor Code was developed, which included several legal modifications. In addition, the Peruvian Congress has approved the “New Telework Law”, which includes new formal requirements, as the obligation to compensate for expenses, tools and services unless otherwise agreed, and health and safety obligations.

Vinatea & Toyama, as the largest labor law & employment firm in Peru, has been providing counselling in all these new regulations to companies in different industries.
