Nadine Montgomery Allam

Nadine Montgomery Allam

Solicitor - Medical Negligence Nadine joined Levy and McRae in September 2022 to commence her traineeship within the L & M Medilaw division of Levy and McRae. During her first year she has gained a wide range of experience within the litigation department focusing primarily on medical negligence. She has been involved in a number of high-profile cases and advised clients on a wide variety of civil claims. Nadine has a particular interest in medical negligence after her own personal experience. She was the Pursuer in the 2015 landmark medical negligence case where a unanimous Supreme Court decision in London changed the UK law with respect to Informed Consent. Nadine’s son, was born with cerebral palsy and left-sided Erbs Palsy, following a 12-minute delay to his birth due to shoulder dystocia. All seven Supreme Court Justices found her Obstetric consultant to be negligent after failing to provide appropriate information regarding options and risks with respect to the mode of delivery of her baby. The Supreme Court reasoned that the previously accepted model of the doctor-patient relationship no longer reflects society and patients nowadays are capable of understanding medical matters. It was held that doctors have a duty to take reasonable care to ensure that a patient of sound mind is aware of material risks inherent in treatment and of reasonable alternatives. Moreover, a doctor must engage in dialogue with a patient, to facilitate their free choice about whether to undergo a proposed course of treatment. Birthrights, a human rights in childbirth charity, announced Nadine as their first ever patron in 2019. In this role, Nadine continues to champion women’s autonomy and consent in childbirth, supporting their communications and campaigns and training for healthcare professionals. Nadine was further honoured to become an Ambassador for the unique charity Baby Lifeline in 2020 and has joined forces with their team to improve safety in maternity care. Nadine's passion for the medical law extends to her membership of the Law Society of Scotland in the Health and Medical Law subcommittee where she is involved in contributing towards the development of policy and legislation to the benefit of both the profession and the public. Nadine is also the class tutor in Delict for the undergraduate law students at the university, teaching all aspects of negligence. Nadine combines compassion from her own personal experience, with excellent legal knowledge to provide clients with the best advice to achieve successful outcomes.
Suzanne Williams

Suzanne Williams

Legal Director Suzanne specialises in Serious Injury and Medical Negligence Claims. Suzanne joined the team in September 2023 and brings with her over 20 years of experience as a practitioner in complex personal injury litigation. Accredited by the Law Society of Scotland as a Specialist in Personal Injury, Suzanne is also accredited by the Association of Personal Injury Lawyers (APIL) as a Senior Litigator and Brain Injury Specialist. Throughout her career, Suzanne has worked with a diverse range of clients on cases involving injuries of the utmost severity, including birth injury, fatal accidents, severe brain injury and spinal cord injury resulting in tetraplegia. Her experience spans the full range of personal injury claims and includes workplace accidents, road traffic accidents and medical negligence. She has experience of working with bereaved families and with adults with incapacity. Suzanne has assisted many clients to set up and manage extensive rehabilitation packages under the Rehabilitation Code, funded by advance damages payments. Over time, she has built up a network of contacts and trusted experts with whom she works to secure the best possible settlement for her clients. Suzanne has a special interest in the impact of trauma and has undertaken additional training to become a qualified psychotherapist, completing the COSCA Certificate in Counselling Skills and the PG Diploma in Person-Centred Counselling and Psychotherapy. Her experience as a trained and practising counsellor gives her a wholly unique perspective in this field and she is passionate about providing clients with empathic, trauma-aware support throughout the legal process.

Levy & McRae’s Clinical Negligence and Personal Injury team are incorporated in L&M MediLaw. Our team is comprised of experts with extensive experience, including first-hand personal experience as individuals in need of assistance with medical negligence and personal injury matters.

L&M MediLaw was launched in February 2022, founded by Elizabeth Rose as a dedicated division of Levy & McRae.  Elizabeth is a medical negligence lawyer with direct experience as a client; her daughter was born with a brain injury caused by medical negligence Elizabeth's story. This is a personal and professional mission for Elizabeth to improve the lives of disabled people and their access to justice - and disrupt the medical negligence market. L&M MediLaw seeks to remove trauma, providing individual care and attention to vulnerable clients.  It is about a genuinely more compassionate and empathetic approach to law, backed with first-hand experience and legal specialism.

The team’s Nadine Montgomery Allam also has direct personal experience of medical negligence matters. Suzanne Williams heads up our Personal Injury team.  Suzanne is a Law Society accredited Personal Injury specialist, APIL accredited Senior Litigator and Brain Injury Specialist and Trauma-Informed lawyer.  She leads a team that deals with a wide range of cases that involve fatal accidents, severe brain injury and spinal cord injury – from workplace and road traffic accidents to medical negligence. As a firm, we deal with some of the most complex catastrophic injury claims, including cases arising out of major incidents and disasters, such as the Lockerbie air disaster and Piper Alpha. We are currently acting in litigation arising out of the Clutha Vaults helicopter crash.

In all medical negligence and personal injury cases, we provide a meeting and initial advice to understand our client’s position and how we can help them not just in financial terms but also in terms of the trauma-informed approach that we bring to our work.  We aim from the outset to go far beyond simply giving them a clear assessment of their claim and their prospects of success: we look for how we can support them emotionally and practically throughout the legal process and give them ‘closure’ following traumatic and often life-changing events.
