In LDS Łazewski Depo & Partners we believe that a clear focus on intellectual property and emphasis on quality is our key to success. We offer strength and experience in all fields of intellectual property protection, including industrial property copyright, unfair competition, advertising law, contract law in business transactions and anti-counterfeiting law. Our clients value and praise us for our knowledge and experience in:

    • obtaining Supplementary Protection Certificates (highly important rights in managing protection life-cycle for blockbuster and other drugs): Managing protection life-cycle for blockbuster and other drugs is one of our key strengths. We have already achieved several positive resolutions and grants going against previous highly restrictive practice of the Polish Patent Office.
    • Pharma Patent Enforcement and Defence: Combining thorough understanding of both the court and administrative systems, we are capable of creating added value over the standard approaches offered by general litigation or prosecution firms. This has led to effective resolution of several very complex enforcement proceedings and a number of pharma patents defended against the odds. The understanding of the Patent Office system and pharma regulatory has always been one of LDS strengths, however the enforcement activities in Poland and LDS involvement in them have both increased, so this has been the primary driver of the practice.
    • process-driven matters (European Patent validations): Our validation team has over ten years’ professional experience in patent validation services. We have developed our own know-how in the proceedings. Thanks to the consolidation of the practices, we ensure safety to patent portfolios of our clients and we are pioneers in launching this innovative, the highest quality system on the Polish market. We keep each stage of the validation process under control, providing quality and on-time delivery of tasks that are critical for our clients. Not only do we deal with routine cases perfectly, but we also boast expertise and experience in handling special situations customized and adapted to our clients’ needs. We are capable of acting in both a standardized and non-standardized way. We have also successfully acted in exceptional, urgent and emergency cases related to restoration of rights.
    • CJEU and EUIPO appeal practice: We have a team of attorneys dedicated to EU court work. This has benefited our clients in their portfolio protection. We have handled numerous challenging legal issues. Verdicts of the General Court of the European Union in cases T-449/13 and T-450/13 annulling decisions of the EUIPO’s Board of Appeals following our applications for annulment were described in the Journal of Intellectual Property Law & Practice of 4 April 2016 as the ones changing the case-law regarding perception of the complex trademarks i.e. word marks are not always dominant, figurative elements may either contribute visually to the overall impression created by the mark or even be the dominant element of that mark.
    • Trademark enforcement: We provide advice and representation in all stages of trademark enforcement proceedings. We understand that a business perspective needs to be put on any enforcement action and are aware of the risk benefit relationship in any economic venture. This is the manner in which we present the case strategy to a client. Effective enforcement is one of the most important considerations at every stage of our work related to trademarks ie: general strategic advice, preliminary injunction, damages awards, non-traditional marks.
    • Product design protection: Our creativity and strategic approach are at their best use in product design cases. This field requires careful co-ordination of unfair competition, design law and trademarks, sometimes also other skills are called for. We believe that only specialization in the field allows to gather sufficient know how to conduct these complex disputes.
    • Anti-counterfeiting: Each brand owner who sees his product counterfeited must answer for himself several key questions, as to the approach, strategy and resources dedicated to fighting fakes. We provide insight into the realities of the Polish legal system based on many years of representing major brand owners in all anti-counterfeiting procedures.
    • Plant Variety Protection: Awareness of the principles and the scope of legal protection of plant varieties is one of the most important factors involved in success in modern agriculture. Obtaining exclusive rights to plant varieties allows breeders not only to recover substantial investments incurred in developing a new plant variety, but above all, to derive long-standing financial benefits from their commercialization. Our law firm, is one of the few offices on the Polish market that provides legal advice and professional assistance in obtaining and maintaining exclusive rights to plant varieties. Our services include:
