Die Beratungsschwerpunkte von Dr. Stefanie Hellmich sind das IT- und Datenschutzrecht sowie der gewerbliche Rechtsschutz einschließlich Fragen des elektronischen Geschäftsverkehrs. Sie berät Unternehmen bei Rechtsfragen der Digitalisierung und bei der Nutzung neuer Technologien sowie beim Entwurf und der Verhandlung von Vertrags- und Geschäftsbedingungen u.a. für IT-Outsourcing- und Software-as-a-Service-Verträge, Vertriebs- und Kooperationsverträge sowie für IT-Support/ Service-Level-Verträge. Im Bereich Datenschutz unterstützt sie Unternehmen umfassend bei der Umsetzung der DSGVO und sonstigen Datenschutz-Compliance Themen einschließlich Gestaltungen des internationalen Datentransfers. Frau Dr. Hellmich berät auch zur Umsetzung der EBA-Guildelines.

Senze berät IT-Anwender und IT-Unternehmen in allen Fragen der Gestaltung und Verhandlung von komplexen IT-Verträgen und bei Outsourcing-Projekten sowie in den Bereichen IT-Litigation und IT-Compliance. Weitere Tätigkeitsschwerpunkte sind das Datenschutzrecht, Telekommunikationsrecht (Regulatory & Commercial), Rechtsfragen des E-Commerce, gewerblicher Rechtsschutz und Wettbewerbsrecht einschließlich der Prozessvertretung. Christian Kuß

Christian Kuß advises national and international clients on legal issues pertaining to IT, copyright and data protection law. He specialises in drafting and negotiating IT contracts, including licensing, IT outsourcing and IT project agreements as well as service level agreements. Another focus area is data protection law, where his advisory services especially include examining the permissibility of future data processing activities and examining and assessing the internal organisation of data protection.

Johannes Klausch is regularly in contact with Luther’s international Best Friends network and our Asian offices and coordinates requests that have an international dimension for medium-sized and international businesses. Johannes Klausch advises on the protection of intellectual property and regularly lectures on the legal opportunities and challenges that come with digitalisation.

Wulff-Axel Schmidt

Dr. Wulff-Axel Schmidt berät in allen Fragen des Wettbewerbs-, Marken-, Urheber und IT-Rechts. Hier widmet er sich insbesondere der Umsetzung von Sourcing- und Schutzrechtsstrategien (beispielsweise bei Unternehmenskäufen und -verkäufen und Unternehmensreorganisationen) sowie der Gestaltung von Lizenz- und Kooperationsverträgen und IT-Projektverträgen. Schwerpunkte seiner Tätigkeit liegen zudem auf dem Gebiet der Neuen Medien und des Datenschutzes. Er hält ständig Vorträge und Seminare zum Wettbewerbs-, Marken- und IT-Recht.

Industry 4.0, Business 4.0, big data, car data, internet of things (IoT), cloud computing, smart home, smart car or e-health: personal data and the way it is being used is becoming an increasingly important part of existing or completely new business areas. At the same time, as digitalisation advances, there is always a situation of potential conflict between economic innovation and the protection of personal data. Compliance with and the violation of data protection laws are thus increasingly becoming the focus of public attention. This means that companies need to find their way around the conflict between their business interests and the legal requirements by ensuring their data protection is very well organised. The processing of personal data is highly regulated. In addition to the EU General Data Protection Regulation (GDPR) and the new German Federal Data Protection Act (BDSG-neu), which has been amended to accord with EU law, sector-specific laws such as the German Telecommunications Act (TKG) or the German Act Against Unfair Competition (UWG) regulate how personal data is handled. Compliance and liability risks must be considered and safeguarded with regard to the exploitation of personal data, which offers attractive business opportunities for companies. The public sector, too, must take into account the special data protection requirements within the framework of the German Federal Data Protection Act.
