Main Areas of Practice

Arbitration & Litigation
The dispute resolution team, which features over 50 professionals, consists of the practice groups arbitration, litigation and debt collection. It represents parties' interests in national and international proceedings and acts before all local, cantonal and national courts across all linguistic areas nationwide. The arbitration team, consistently pursuing a partner-oriented approach has successfully proven its competence as both arbitrator and legal representative in a large number of national and international disputes.

Construction, Real Estate and Hotels
With in-depth specialist knowledge, wealth of experience and multidisciplinary approach, the 35 expert team members offer professional and comprehensive advice and support to companies in terms of project management and realization. The focus is on providing solution approaches as simple and transparent as possible, with a view on any conceivable issues and challenges concerning plots of land, properties, infrastructure facilities, building constructions and the like from a holistic perspective. Equally considered are economic and financial aspects.

Corporate & Transactions
Serviced by over 40 fee earners, this practice encompasses the Law areas Banking, Stock Exchange, Financial Services, Fintech and Blockchain, Company, Capital Market, Collective Investment, Notarial Services, Restructurings and Reorganizations as well as M&A. It handles all aspects of transactional work throughout all stages of the life-cycle of companies, both for privately held and listed entities. The practice focuses on the small and mid-cap segment, both domestically and cross-border.

Employment
The 25 lawyers have more than thirty years of experience in all areas of employment and public personnel law, including litigation and arbitration. The team offers support for employment contracts, personnel regulations, benefits and compensation, incentive/bonus plans, employee participation plans, collective labour agreement negotiations, global mobility planning, enforcement or defense of employment law claims in court or arbitration proceedings and much more.

Energy
The expertise of this practice team consisting of 15 professionals covers in particular the electricity market and the corresponding grid regulation, the gas market and gas grid regulation as well as issues relating to the CO2 Act and the promotion of renewable energies and the associated transition away from fossil fuels. Clients include public authorities as well as public and private companies and private individuals seeking support in connection with legislative processes in the field of energy law, in the reimbursement of grid surcharges or in the context of the licensing of energy generation plants.

Financial Services and Insurances
Advising financial services providers is one of the firm’s strength. The practice team composed of some 20 specialists supports both global and Swiss banks and insurance companies of all sizes competently and effectively across a broad range of legal and regulatory areas. Clients include independent asset managers as well as corporate clients, management representatives and employees - provided there is no conflict of interest.

International Practice
The 30 attorneys of the firm’s international practice team – many of whom have working experience abroad, held senior in-house positions in international enterprises or have a multi-cultural background – are experts in cross-border issues and in managing multi-jurisdictional projects. Specialized legal and industry knowledge combined with linguistic and cross-cultural skills have helped establishing trusted contacts in almost every jurisdiction and place on earth, representing a truly global network. The services offered feature support and coordination of cross-border as well as international projects and matters (e.g. transactions, arbitration proceedings and litigations), selection of suitable local attorneys, coordination of or cooperation with local lawyers, obtaining information abroad and advice on foreign law, bridging language and mentality barriers. Bratschi Ltd. can call on specialized teams for the regions Italy, Spain and Latin America, French speaking areas as well as for the US.

Pharmaceuticals & Healthcare
The team composed of 10 professionals supports healthcare service providers in the areas of social security regulatory authorisations, professional law, data protection, tariff negotiations and tariff settings, planning, liability issues and compliance. It also provides advice to its clients in the pharmaceutical, medical device, biotechnology, life sciences, chemistry, foodstuffs and cosmetics sector on their day-to-day business, for example in research and development, intellectual property enforcement, regulatory authorizations, advertising and distribution issues, pricing strategies and reimbursements under social security law as well as all regulatory issues and data protection. Professional support is also available for contracts, strategic agreements, competition and antitrust, tax law, corporate transaction as well as for legal, administrative or criminal proceedings.

Public Sector
The team with a headcount of currently 12 highly experienced specialists regularly advises in all areas of Swiss Public and General Administrative Law, more specifically in the practice fields of Energy, Medical and Healthcare, Media, Education, Public Labor, Constitutional and Municipal Law. Clients include private individuals, public and private companies as well as public authorities such as municipalities, cantons and the Confederation.

Taxation
The firm’s department provides tax advice for companies, individuals, financial institutions, institutional and private investors, partnerships, trusts, estates, family offices, charitable foundations and NGOs. The services offered by 16 professionals include amongst others M&A structuring and post-closing integration (incl. due diligence), real estate transactions, corporate and financial restructuring, reorganization, advice on corporate financing and capital market transactions, relocation of companies and individuals, succession and estate planning as well as representation in courts.
