St Paul's Chambers is home to 'assured advocate' Sophie Mitchell who is frequently instructed by public bodies in data protection work, including central government, the NHS, police forces, and child protection agencies. Recent instructions of note included acting for the defendant in Ian Kerry v The Judicial Conduct and Investigations Office where the court was tasked with looking at whether the retention of complaints was in breach of the Data Protection Act 1998, the Human Rights Act 1998, and/or negligent. In Paul Reid v The Ministry of Justice, Mitchell represented the MoJ in an action brought by a prisoner who claimed that a personal letter erroneously passed on by prison staff to another prisoner with the same name amounted to a breach of data protection law.
