Simmons & Simmons

Simmons & Simmons' Amanda Lees is very much part of the Singapore arbitration community. The team impresses with its market share of India disputes, commodity trading disputes and investment treaty arbitrations. Working alongside colleagues in London, it represented the government of the Republic of Indonesia in a bilateral investment treaty arbitration brought by Indian Metals & Ferro Alloys under the India-Indonesia bilateral investment treaty (BIT). It also acted for Tozzi Industries in a dispute with Bumi Armada Offshore and Bumi Armada Berhad regarding the floating production storage and offloading vessel (FPSO) for the Madura BD gas field in Indonesia; proceedings were eventually transferred to the Singapore International Commercial Court (SICC) where judgment went in favour of the client in September 2017.

Simmons & Simmons' Singapore team is principally known for its structured trade and commodity finance expertise, and has experienced an uptick in margin loans, bridge financings for projects and fund financing. The group advised Standard Chartered as arranger and a syndicate of lenders on an uncommitted secured borrowing base facility to Phoenix, a global agricultural and food company, for the expansion of its rice business portfolio in India, Asia and Africa. It also represented Gunvor on its Asian syndicated committed revolving loan facilities, involving 38 syndicate banks. Calvin Tan, Dan Marjanovic  and Matthew Cox are the key partners in the team.

Simmons & Simmons' practice in Singapore is particularly strong on the structured products and derivatives sides, and acts for a range of buy-and-sell-side clients including UBS, Deutsche Bank, JP Morgan, Dymon Asia Capital and Q Investment Partners. Highlights included advising UBS as arranger on a number of fund-linked/fund-backed structured and actively managed note issuances by several Irish and Dutch SPVs. Jason Valoti has 'in-depth knowledge and an ability to provide practical solutions', and is 'good at incorporating his practical viewpoints into legal advice'. Newly promoted partner Jonathan Quie has 'in-depth knowledge'.

  • Failure to counter financial crime: Norwich Union Life

    In December 2007, the Financial Services Authority (FSA) imposed a fine of ÂŁ1.26m on Norwich Union Life (part of the Aviva Group), one of the largest life insurance businesses in the UK with around seven million customers. The fine related to failures to take reasonable care to establish and maintain effective systems and controls for countering the risks of financial crime. The fine is the latest confirmation of the emphasis being placed on protecting clients and customers from the threat of financial crime.
