Frasers Law Company handles strategic, regulatory and transactional matters pertaining to telecoms, the sharing economy, streaming entertainment, among others. Justin Gisz advised Vietnam Infrastructure Station on the sale of 2,000 telecoms towers, while Mark Fraser also leads key deals. Other clients include China Telecom Global, telecoms companies, international technology ‘unicorns’ and venture capital funds.

Freshfields Bruckhaus Deringer advises range of international investors on transactions into the TMT sector in Vietnam. Don Stokes, who is based in Ho Chi Minh City, handles a range of work concerning telecoms developments elsewhere in Indochina: he advised OPIC on financing several projects in Myanmar, and Viettel on its role in a joint venture, which is also investing in Myanmar telecoms. Tony Foster in Hanoi handles sector-relevant transactions, including advising CJ E&M on its purchase of a majority stake in Blue Group, an advertising and entertainment producer and distributor.

Rajah & Tann LCT Lawyers provides ‘a top-notch level of service’ and ‘clearly understands the issues at hand and designs a course of action to fit’. The team acts for leading worldwide and regional names in the social media, entertainment, online banking and education technology areas. Logan Leung, who ‘deserves recognition for his work ethic’, Vu Thi Que and senior associate Trinh Minh Duc advised iflix, a Malaysian video-on-demand service, on its entry into the Vietnamese market. Leung and Tran Thi Phuong Thao advised a telemedicine provider on launching a product that allows Vietnamese patients to directly interact with doctors based in Singapore via an app.

Russin & Vecchi, LLC advises start-ups and established names alike on regulatory and transactional matters. Nguyen Huu Minh Nhut advises Google and Baidu on regulatory matters, including data protection and local content regulations, as well as assisting Intel with data protection regulations regarding cloud computing. Mai Thi Minh Hang advises Upstream, a mobile advertising and infotainment company, on its operations. Other clients include Trust Circle, which Nhut advises on providing app-based peer to peer finance, Nokia and CoFounder Venture Partners.

Audier & Partners Vietnam L.L.C.’s work covers investments in e-commerce, software and broadcasting. Etienne Laumonier advises a major software developer on the exit of several investors, and Nicolas Audier led a team advising a print media company on entering the market. Nicolas Picard advised Zalora on restructuring its e-commerce activity in Vietnam.

Baker McKenzie’s ITC practice, headed by Yee Chung Seck, handles technology-rich transactions, restructuring and financing matters covering e-payments, telecoms and online retail. Tran Manh Hung and Chi Lieu Dang advised Microsoft on the Vietnamese elements of the sale of its feature phone business to Foxconn. Oanh Nguyen has telecoms project finance expertise.

Lexcomm Vietnam LLC, in addition to advising on telecoms regulations, assists local broadcasters with major broadcast content deals. Nguyen Viet Ha advised VTVcab on the purchase of television rights to the UEFA Champions League as international and Vietnamese counsel in a $3.5m deal involving California and Vietnamese law; he also advised Yan TV on purchasing the broadcast rights to the 2016 Olympic Games. Telecoms regulation, where clients include Southeast Asia Telecommunications Holdings, is another area of expertise.

    On 6/20/2012, the National Assembly voted to adopt the Law on Price (the "LOP") in response to the public demand for an effective legal framework to control price manipulation from dominant enterprises such as gasoline, electricity, etc. The law will take effect from 01/01/2013 and repeal Ordinance No. 40/2002/PL-UBTVQH10 dated 26/4/2002 of the National Assembly Standing Committee (the "Ordinance"), which is conceived as outdated and containing certain provisions contravening the WTO’s regulation. This article describes the main features of the law and provides some insight into its potential impacts on the Vietnamese economy.
