Work highlights

Representing the California Trucking Association in a federal lawsuit alleging that the California Air Resources Board’s (CARB) adoption of the Advanced Clean Fleets regulation is pre-empted by federal law and improperly impairs commerce amongst the states.
Acting as lead counsel for Bob’s Discount Furniture, LLC (“BDF”) in two purported class actions in state and federal court in New Jersey, brought by furniture delivery truck drivers who allege that BDF, and another motor carrier BDF contracts with, misclassified them as independent contractors when they should have been treated as employees entitled to overtime under New Jersey Wage and Hour Laws.
Represented, successfully, BNSF Railway company against the EEOC in alleged sexual harassment claims.
