Represented client in a civil qui tam litigation in the district of New Jersey where the client's off-label marketing of two products used to treat HIV/Aids was alleged to have violated the Federal and State False Claims Act (FCA) and the Federal Anti-Kickback Statute. The qui tam complaint was unsealed in 2016 following a declination from the U.S. Attorney's Office for the District of New Jersey. The parties extensively briefed novel legal issues related to the FCA at the motion to dismiss stage, and the firm succeeded in getting the parent company of the client dismissed from the case. In 2023, the court ruled favorably on several motions in which the firm had filed behalf of the client and excluded evidence that was irrelevant and otherwise encroached on the court's and jury's roles. The case went to trial in 2024, where the jury found supported some of the claims against the client. The judgement was appealed by the client and is currently pending before the U.S. Court of Appeals for the Third Circuit.
