Work highlights

Advised Acorda and its affiliated entities (collectively, the “Debtors”) in their chapter 11 cases in the US Bankruptcy Court for the Southern District of New York (the “Bankruptcy Cases”). Acorda is a public company that was listed on NASDAQ until the filing of its Bankruptcy Case.
Advised the Board of Directors of Logix in a series of recapitalization transactions to bolster liquidity and position the Company for long-term growth. Logix faced a liquidity crisis at a time when it had nearly $300 million in funded indebtedness.
Obtained recognition of the Foreign Representatives under Chapter 15 of the U.S. Bankruptcy Code (“Chapter 15”) in the United States Bankruptcy Court for the Southern District of Florida (the “Bankruptcy Court”). In 2022 we commenced three adversary proceedings against affiliate entities and former directors and officers of the Debtor, seeking recovery of more than $120 million of the Debtor’s funds. In May of this year the Bankruptcy Court denied a legal challenge to our claims against the Debtor’s former executive directors for violation of the U.S. Racketeer Influenced and Corrupt Organizations Act (the “RICO Act”).
