Work highlights

Achieved dismissal with prejudice of a putative class action against the largest magazine publisher in the country, Dotdash Meredith Inc. In a precedent-setting decision that will affect future actions under this law, especially for media companies, the court held that Dotdash Meredith did not qualify as a commercial entity under the act and that plaintiffs’ claims were not plausible.
Secured a victory in the U.S. Court of Appeals for the 10th Circuit for our client, The Boppy Company LLC, affirming dismissal of a putative nationwide class action filed in the District Court of Colorado. The court granted the motion to dismiss those claims with prejudice, finding that Boppy had clearly and adequately warned caregivers that they should not allow their infants to sleep in the Newborn Lounger. The 10th Circuit affirmed dismissal with prejudice.
Achieved a sweeping summary judgment victory on behalf of our client Mammoet, a Dutch heavy lifting contractor that formed a joint venture to engineer and construct a landmark project in New York, NY. The court found the developer breached and dismissed all claims against our client after full briefing and a full day’s argument.
