Serving as lead counsel on behalf of Major League Baseball Advanced Media, L.P. in a case alleging breach of contract, patent infringement, and trade secret misappropriation relating to pitch tracking and strike-zone-graphic rendering technology for Major League Baseball games. This case has involved dozens of depositions, numerous hearings, and extensive motion practice. The parties are currently in expert discovery.
Serving as strategic and trial counsel defending against antitrust class actions and opt-out actions claiming that Merck’s settlement agreement contract resolving a Hatch-Waxman patent case regarding the cholesterol drug Zetia violated federal and state antitrust, consumer protection, and unjust enrichment laws. The team took and defended key fact and expert depositions and contributed to major pre-trial briefing and oral argument in preparation for the MDL jury trial. The MDL settled during trial in April 2023 with the team ready to deliver the opening statement and cross and present key contract-dispute witnesses.
Serving as strategic and trial counsel to Merck in more than a dozen patent-infringement suits brought under the Hatch-Waxman Act concerning Merck’s Bridion product.
