Work highlights

Secured a precedent-setting victory at the New York Court of Appeals for current and former officers and directors of Barclays Plc and its subsidiary, after a year's long saga through the court system, in a shareholder derivative action alleging breach of fiduciary duties on behalf of Barclays, a UK-organized corporation. It raised the question whether New York's internal affairs doctrine was overruled by Business Corporation Law § 1319, which mandates application of New York law. The NYS Supreme Court rejected the plaintiff’s theory and confirmed the continuing application of the internal affairs doctrine.
Led a team of several firms on behalf of FS Credit Opportunities and represented various investment funds to convince the U.S. Supreme Court to take up an important case about the Investment Company Act of 1940 (ICA).
Represented the Chilean salmon farming company Australis and its new owner, Food Investment Services, which brought claims against its former owner Isidoro Ernesto Quiroga Moreno and South Lake One LLC (South Lake), alleging that Mr. Quiroga fraudulently transferred Chilean real estate to South Lake.
