Representing Nikola Motor Company, a publicly-traded manufacturer of heavy-duty commercial electric trucks and energy solutions, in a successful arbitration that resulted in a $165m award, plus interest, for reimbursement from Trevor Milton, its former founder, Executive Chairman and CEO, who was convicted of securities and wire fraud in the Southern District of New York, for the damages and costs related to government and regulatory investigations caused by his conduct, including a December 2021 settlement with the U.S. Securities & Exchange Commission and the associated $125m civil penalty.
Representing Teva Pharmaceuticals in connection with an indictment brought by the United States Department of Justice’s Antitrust Division alleging that Teva participated in three alleged conspiracies to suppress and eliminate competition by agreeing to fix prices, allocate customers, and rig bids for generic drugs.
Representing Jose Uribe, a New Jersey businessman, in the ultra-high-profile case U.S. v. Robert Menendez, et al., in which then sitting United States Senator Robert Menendez and his wife, Nadine Menendez, along with three New Jersey businessmen, were charged with conspiracy to commit bribery and conspiracy to commit honest services fraud for, among other things, payments on a Mercedes Benz purchased for Nadine Menendez in exchange for Senator Menendez’s intervening in a New Jersey Attorney General’s investigation of one of Mr. Uribe’s colleagues.
