Represented Starbucks Corporation in multiple appeals concerning constitutional and statutory questions arising from NLRB proceedings. The firm secured a victory before the Eighth Circuit, which held the board applied an incorrect standard regarding alleged employee interrogation, and further victories before the Third and Sixth Circuits, which vacated monetary remedies as exceeding the scope of the NLRA.
Secured a unanimous U.S. Supreme Court ruling for E.M.D. Sales, Inc. confirming that the preponderance-of-the-evidence standard applies to FLSA exemptions.
