Theresa Weisenberger is a proven leader and trusted counsel who co-leads both BakerHostetler’s intellectual property (IP) and technology transactions practice and its cross-practice AI team. With a background in electrical engineering and experience in both patent prosecution and patent litigation, she has a strong grasp of her clients’ technology and is skilled at facilitating communications between technologists and executive leadership. As a pragmatic advisor, she recognizes that IP does not exist in a vacuum and that its value exists only as long as it furthers her clients’ business goals.
Theresa is comfortable on the cutting edge of technology and unsettled law and provides clear recommendations for “future proofing” her clients’ research and development and business strategies against new legal landscapes, particularly as it relates to AI technology. As a fierce advocate, Theresa routinely negotiates high stakes transactions between her clients and their technology providers.
In addition, Theresa works with utilities and technology, gaming, healthcare, construction and other companies to develop IP protection and enforcement programs, including conducting IP and AI audits, creating IP and AI policies, capturing inventions, shaping global IP strategy, providing infringement risk analysis, advising on OSS compliance and leading employee education programs on these topics.
Her clients also depend on Theresa to manage development deals and structure technology acquisitions, data licensing agreements and SaaS and XaaS contracts. Central to these technology agreements is working with clients to understand the risks between providers and tech clients, including how licensing third-party technology can impact their IP rights and obligations to their clients.
Theresa is recognized by IAM Patent 1000, The Legal 500 and The Best Lawyers in America® for her excellence in IP litigation, prosecution and transactions. She presently serves as the Secretary and Vice President of Governance of the Copyright Society. She is a strong believer in the value of copyright protection for her technology clients, and regularly speaks on the intersection of copyright law and emerging technology.
