NOVAS MEDIDAS

As novas medidas de natureza preventiva e repressiva de combate ao branqueamento e ao financiamento do terrorismo, estabelecidas na Lei n.º 83/2017, de 18 de agosto, vão entrar em vigor no dia 17 de setembro de 2017.

Este novo diploma transpõe parcialmente as diretivas 2015/849/UE, do Parlamento Europeu e do Conselho, de 20 de maio de 2015, e 2016/2258/UE, do Conselho, de 06 de dezembro de 2016, altera o Código Penal e o Código da Propriedade Industrial e revoga a Lei n.º 25/2008, de 5 de junho, e o Decreto- Lei n.º 125/2008, de 21 de julho.

1. NOVAS MEDIDAS DE CONTROLO INTERNO

No que concerne ao tipo de políticas e procedimentos de controlo interno e práticas de gestão de risco é agora imposta às entidades obrigadas a instituição de: (i) processos formais de captação, tratamento e arquivo de informação relativa à análise e tomada de decisões sobre potenciais suspeitas; (ii) mecanismos de teste à qualidade, adequação e eficácia desses
