Par une décision n°2020-11 du 1^er mars 2022, la Commission des Sanctions de l'ACPR¹ a sanctionné la société W-HA, filiale d'Orange, exerçant son activité sous le statut d'établissement de monnaie électronique sur le fondement du dispositif de lutte contre le blanchiment de capitaux² et le financement du terrorisme³.

Le produit offert à la vente, portant le nom « Orange Money France » (OMF) reposait sur la fourniture d'un forfait mobile associé à la possibilité d'ouvrir un compte de monnaie électronique. Ce compte permettait d'effectuer des transferts d'argent, par le biais de l'application mobile, depuis la France et à travers le monde.

Compte tenu de cette activité, l'ACPR a considéré que la filiale d'Orange avait manqué à ses obligations de :
