Isonomia entre Consumidores Livres/Especiais e Cativos

O pacote de medidas implementadas pelo governo desde o final de 2012 trouxe uma série de questionamentos jurídicos e uma crescente judicialização no setor elétrico. Dentre tais questionamentos está a falta de isonomia entre consumidores livres ou especiais e consumidores cativos. Tal fato decorre da alocação, somente aos consumidores cativos, de redução tarifária decorrente (i) de quotas da energia amortizada oriunda das concessões de geração que foram renovadas, e (ii) de parte da desoneração de encargos aplicável a tais concessões. Além disso, certos alívios financeiros provenientes de contas do setor elétrico foram alocados somente aos consumidores cativos para compensar exposições decorrentes do despacho termelétrico, trazendo novamente a falta de isonomia com consumidores do mercado livre.
