Executive Summary

The Federal Trade Commission has released a final rule to update the Children's Online Privacy Protection Rule. Our Privacy, Cyber & Data Strategy Team discusses how the changes would heighten website operators' responsibilities to protect data collected from children.

  • Requires operators to obtain separate parental consent for sharing personal information collected from children with third parties
  • Broadens the definition of "personal information" to include biometric and all government-issued identifiers
  • Expands operators' requirements to include a written data retention policy for protecting information from children

On January 16, 2025, the Federal Trade Commission (FTC) announced the finalized amendments (Final Rule) to the Children's Online Privacy Protection Rule (COPPA Rule), which regulates operators of websites and online services that collect personal information from children under the age of 13.
