Position
Lydia is a full member of the Society of Trust and Estate Practitioners (TEP) and a full member of the Association of Contentious Trust and Probate Specialists (CTAPS). She is ranked as a “Leading Junior” in both the Legal 500 (2025) London (Private client: trusts and probate) and Regional Bar (Midland Circuit – Chancery, probate, and tax). She sits a Recorder in public and private family law and is also authorised to hear financial remedy cases.
With a traditional chancery and private client practice, Lydia has an extensive understanding and considerable experience of contentious probate and estate matters. Lydia has considerable experience in bringing and defending financial provision claims under the Inheritance (Provision for Family and Dependants) Act 1975, along with TOLATA and other equitable claims. She regularly appears in the High Court in trials and interim applications.
Alongside her private client work, Lydia accepts instructions in respect of shareholder disputes/unfair prejudice petitions and financial remedies cases.
Lydia also accepts joint instructions to provide Early Neutral Evaluations, both in writing and person.
Career
Lydia Pemberton (TEP)(CTAPS) has a traditional chancery practice and extensive experience and understanding of probate and estate dispute. She advises and represents clients in cases concerning the substantive validity of wills, the construction and interpretation of testamentary documents, rectification claims, the appointment and removal of personal representatives and trustees, breach of trust claims, and other matters arising in the administration of estates and the contentious business of the Business and Property Courts. Lydia also advises in respect of interim grants, contested applications by those entitled in equal priority to a grant, contested caveat removals, and other matters arising in the Non-Contentious business of the Probate Registries (Family Division). Lydia frequently advises and acts in Inheritance Act and TOLATA claims. Lydia is a full member of the Society of Trusts and Estate Practitioners and a full member of the Association of Contentious Trust and Probate Specialists. Lydia also sits as Recorder on the Midland Circuit.
