Position

David’s practice comprises Commercial and Chancery Litigation and Arbitration with particular emphasis on Insurance and Reinsurance, Company and Insolvency, Civil Fraud and Asset Tracing and Media and Entertainment in England and other jurisdictions in the Caribbean and Far East.

David is a member of COMBAR and the Chancery Bar Association. He is called to the Bar of the British Virgin Islands and has been called to the Bar of the Cayman Islands and the Bar of the Seychelles for particular cases. David is a Fellow of the Chartered Institute of Arbitrators and is called to the New York State Bar (FLC).

David is a major figure on the commercial litigation scene, both onshore and internationally.  As well as appearing regularly in the English courts, he frequently acts in the BVI, Cayman Islands and other offshore jurisdictions.  The cases that David acts on tend to be extremely large and complex and invariably with a multi-jurisdictional element.

He has a speciality in dealing with fraud and dishonesty type matters in a multi-jurisdiction context and in disputes where there are insolvency issues (including cross-border insolvency) and/or questions of insurance and reinsurance.

David has acted in a number of cases involving Russian and other Eastern European “oligarchs” (eg Cherney v Deripaska in the Court of Appeal). He acted for the Galagaev claimants in proceedings against the Ananyev brothers in the Commercial Court and in confidential proceedings against a Russian Bank involving the appointment of receivers in England and the BVI.

David has a particular speciality in funds litigation, especially hedge funds litigation, and is acting in major internal international litigation involving proceedings in England, the BVI, the Cayman Islands Russia and China.
