Position

Gareth Duncan is an experienced family law barrister, known for clear advocacy and a practical, hands-on approach in both public and private law proceedings.

He represents local authorities, parents, and children across a wide range of complex and sensitive cases, and also accepts instructions on a direct access basis.

In public law, Gareth is instructed regularly in care and adoption proceedings, including cases involving non-accidental injury, sexual abuse, domestic abuse and neglect. He has experience in multi-expert cases and proceedings with jurisdictional complexities, including cross-border placements.

Gareth is trusted by local authorities and guardians alike, and is recognised for his ability to represent parents in highly challenging circumstances. He understands the needs of vulnerable clients, particularly those with mental health conditions, and is skilled at both realistically managing expectations and building trust.

In private law, Gareth has extensive experience acting for parents and Rule 16.4 Guardians. He is regularly instructed in cases involving serious allegations of physical and sexual abuse, fabricated illness, and issues of parental alienation. He also acts in internal and external relocation cases and is known for his sensitive handling of high-conflict disputes.

Gareth was appointed as a Deputy District Judge and Fee-paid Judge of the Employment Tribunal in April 2020. His dual perspective as advocate and judge has contributed to his ability to navigate complex proceedings with fairness and focus.
