Career
Brian T. Goldman’s wide-ranging commercial litigation practice spans both trial and appellate litigation in high-profile, front-page matters, and his successes have been recognized in Law360’s Legal Lions column and in The American Lawyer’s Litigator of the Week column.
Brian has helped try several trade secrets cases, among other areas. Brian was on the trial team representing aerospace start-up Zunum Aero Inc., winning a jury verdict in May 2024, in which Brian examined multiple witnesses, finding Boeing liable for $81.3 million for misappropriating substantial trade secrets related to the development of electric and hybrid-electric aircrafts, earning the team a significant win. He also helped obtain reinstatement of the verdict on appeal in the Ninth Circuit after the district court set it aside (as well as an order reassigning the case to a different district judge for post-verdict proceedings). And Brian was on a trial team that secured a defense-side trade secret verdict in a jury trial in January 2026, where Brian also examined multiple witnesses.
Brian also represented at both trial and on appeal investment funds in a dispute with Serta over its COVID-related refinancing, securing the reversal of the bankruptcy court’s judgment on the core contract issue.
On the appellate side, last year, he argued and secured a favorable decision at the New York Appellate Division in Poltorak v. Clarke, where the Second Department held that a statute imposing a financial penalty on judges “violates the Compensation Clause of the New York State Constitution, as well as the separation of powers doctrine, the tenet upon which our democracy rests[.]” Brian has also helped secure multiple Supreme Court certiorari grants, including as lead counsel in Pierre v. United States, in which the Court granted the petition, vacated the decision below, and remanded for further proceedings. Most recently, in May 2026, Brian was part of the HSG team that secured a cert grant in a case presenting the question whether Title IX’s private right of action extends to employees of federally funded educational institutions.
