Career

Scott Danner’s practice focuses on complex commercial litigation in federal and state courts, including disputes involving trade secrets, antitrust claims, private equity transactions, and secured debt. Since becoming a partner at Holwell Shuster & Goldberg in 2020, Scott has first-chaired jury and bench trials in federal and state court, securing multiple eight-figure verdicts for his clients, and first-carried over a dozen arbitrations through final hearings.

Scott’s previous engagements include securities-related matters, fiduciary duty claims, and bankruptcy and distressed debt litigation. He also has extensive experience representing clients in New York appellate courts, including successful appeals to the New York Court of Appeals and the Appellate Division, First Department. Scott is actively involved in HSG’s pro bono practice, and regularly represents indigent criminal defendants on appeal. He is a member of the New York City Bar Association Trade Secrets Committee and previously served as the co-chair of the Appellate Courts Committee of the New York County Lawyers Association.

Recently, Scott was lead trial counsel for aerospace start-up Zunum Aero Inc., winning a jury verdict in May 2024 finding Boeing liable for $81.3 million for misappropriating substantial trade secrets related to the development of electric and hybrid-electric aircrafts. The Ninth Circuit reinstated that verdict after the district court set it aside and reassigned the case to a different district judge for post-verdict proceedings, including potential exemplary damages. Scott currently serves as lead trial counsel for SDR Group, a geophysical surveying and logistics technology company, in claims against Lockheed Martin alleging trade secret misappropriation, and as lead trial counsel for videogame company Valve Corporation, defending against a mass arbitration campaign alleging claims under U.S. antitrust laws. Scott also co-leads HSG’s representation of private equity firm H.I.G. Capital as plaintiff in a fraud case pending in Delaware Superior Court. H.I.G. purchased a majority stake in a portfolio company, Mobileum, Inc., from another private equity firm, Audax Group, in a $915 million transaction.

Previously, Scott represented Valassis Communications, a MacAndrews & Forbes company, as plaintiff in a jury trial in the Southern District of New York involving an antitrust claim against News Corp. and its subsidiaries seeking hundreds of millions of dollars, and led a damages trial team that secured a $70 million win on behalf of investment fund client Melody Business Finance involving loans defaulted on by financier Philip Falcone. Scott has also secured multiple notable wins before New York’s highest court, including a landmark reinsurance decision and a reversal of a conviction in a highly-politicized criminal prosecution.

Scott has been recognized as a Litigation Trailblazer by The National Law Journal, a leading Antitrust Lawyer and leading Litigator by Lawdragon, and an “amazing trial lawyer” by his clients, as reported by Legal 500. He was also recommended in Legal 500’s 2021 guide for his litigation work and recognized by The American Lawyer and Law360 for his recent trial wins.

Scott clerked for the Hon. Colleen McMahon of the Southern District of New York and the Hon. Robert S. Smith of the New York Court of Appeals. He started his career in private practice at Wachtell, Lipton, Rosen & Katz.
