José Ignacio Mercado

Counsel at Carey's Data Protection and Technology Group. His practice focuses on matters related to privacy, data protection and cybersecurity, as well as intellectual property and the development of strategies to protect intellectual and industrial property, including preparation, negotiation and implementation of technology transfer agreements such as licensing agreements, franchising agreements, distribution agreements, among others.He also has experience assisting technology companies with the preparation and implementation of commercial scale-up and go-to-market actions, both in Chile and abroad.His practice also includes advice on regulatory matters in the pharmaceutical, cosmetic, food, and medical devices industries, as well as on topics regarding marketing and promotion of these products.

Carey advises companies on the drafting, implementation and compliance of their privacy policies. To that effect, the firm assists its clients throughout the whole “life cycle” of the data in the company: drafting complete and sufficient data processing authorizations, advising them on the data management of their clients and employees, both in the country and internationally, preparing data transfer agreements that comply with national and international standards, among other scenarios.

Carey also provides advice on image rights, honor and privacy rights, drafting and negotiating agreements for the protection and commercial exploitation of image (publicity rights) and other intangible assets related to privacy.
