Career

Jen Maisel is a highly skilled strategist and thought leader in intellectual property (IP) law and litigation. She serves as co-chair of Rothwell Figg’s artificial intelligence (AI) practice team and advises both large corporations and emerging companies on protecting and leveraging their groundbreaking innovations in artificial intelligence (AI), virtual reality, big data, the Internet of Things, privacy, cybersecurity, quantum computing, and blockchain. With technical experience developing language models for natural language processing applications, Jen is uniquely equipped to guide clients through complex IP, data protection, and privacy challenges in the AI space and has been doing so for over ten years.

Jen represents news organizations from across the United States, including The New York Times, Chicago Tribune, U.S. News and World Report, and many others in groundbreaking litigations against Microsoft, OpenAI, and Perplexity AI alleging copyright infringement arising from the training of their generative AI tools. In addition to advising clients on the novel legal risks posed by AI technologies, she establishes AI governance programs and policies to mitigate legal risk and preserve rights; advises on content licensing agreements; and provides patent-related services and trade secret protection strategies for AI innovations. She is a frequent speaker and writer on the intersection of AI and IP, appearing at leading industry conferences and in publications and podcasts.

Beyond her AI-focused practice, Jen counsels clients across industries on identifying, securing, and monetizing their IP rights, including patents, trade secrets, copyrights, trademarks, data rights, and open-source frameworks. She has prosecuted hundreds of patents to allowance and her litigation experience spans district courts nationwide, the U.S. Court of Appeals for the Federal Circuit, and the U.S. Supreme Court. A registered practitioner before the U.S. Patent and Trademark Office (USPTO), Jen provides strategic counsel as to the scope, validity, and enforceability of rights of existing patents.
