Career

Giacaglia has dedicated 15 years to shaping Brazil’s antitrust landscape. In 2024, he represented a health insurance company in opposing a vertical-integration merger blocked by CADE, the Brazilian antitrust authority, joining a short list of prohibitions that year. He also acts for several companies in a major HR data-sharing case. In a class action, he addresses issues related to antitrust, poaching, and national security, securing favorable rulings. As lead associate, he successfully obtained the suspension of CADE's preventive measures against a large technology company, demonstrating his expertise in digital and civil litigation. Throughout 2024, he led numerous merger filings, including major restructuring deals, the first sports betting filing, and cases involving agribusiness, software, and retail.

He has been recognized by major publications for his extensive work, including a successful acquittal in a US export cartel case, remedies addressing potential competition in the most complex agrochemical merger ever assessed by the authority, the disputed US/Brazil aircraft producer merger, the unique Forex class action, Brazil’s largest health insurance merger, and the first conglomerate merger involving finance and technology assessed by CADE, among many others.

Active at IBRAC—Brazil’s premier antitrust forum—and São Paulo Bar's Antitrust Committee, he hosted 15+ IBRAC podcast episodes on CADE rulings in 2024, moderated a panel at the IBRAC International Antitrust Seminar with Latin American experts, and led discussions on CADE's Trustee Manual with CADE.

Nominated for the Antitrust Writing Awards by Concurrences and The George Washington University for one of his many 2024 articles, he also worked in antitrust at Cleary Gottlieb's Washington, DC office, holds two LL.M.s (University of Chicago and Corporate Law), a postgraduate degree in investigations, and is admitted to the New York and Brazilian Bars.
