Brian R. Michael is a partner in Morrison Foerster’s Investigations + White Collar Defense Group and the chair of the firm’s Global Ethics + Compliance practice.
Regarded as one of the top lawyers in California, Brian draws upon more than 25 years of experience in private practice, as an in-house legal and compliance leader and as a federal prosecutor in the Southern District of New York and the Central District of California, to represent corporate and government entities, boards of directors, and individuals across industries and geographies in high-stakes and often high-profile white collar criminal cases, internal and government-facing investigations, securities and regulatory enforcement matters, and related complex litigation. Brian’s clients frequently rely on him for critical crisis management, as well as for sensitive compliance counseling, including FCPA/anti-corruption, AML, cartel/TCO, cybersecurity, trade sanctions, FinTech and blockchain, corporate responsibility, whistleblowing, and workplace misconduct matters. Brian also leads global risk assessments and helps companies design, implement, and enhance cross-border compliance programs.

Before joining MoFo, Brian was a partner in the Los Angeles office of another leading law firm, where he successfully launched the firm’s white collar criminal defense and investigations practice on the West Coast.
Previously, Brian spent nearly five years as Deputy General Counsel and Group Chief Compliance Officer at media and entertainment company 21st Century Fox, and more than eight years as an Assistant United States Attorney in both the Southern District of New York and Central District of California.
At 21st Century Fox, Brian served on the global Compliance Steering Committee and played a lead role in the company’s successful response to multiple cross-border investigations, including the “UK phone hacking” crisis and the FIFA corruption scandal. Brian led the development and oversight of the global compliance program for all of the Fox broadcast, cable, digital, and sports media businesses, including more than 300 channels in over 180 countries, and for National Geographic Partners.
As a federal prosecutor, Brian tried numerous cases and briefed and argued multiple appeals in the Second and Ninth Circuit Courts of Appeal. He led investigations and prosecutions involving complex financial fraud, securities fraud, healthcare fraud, cybercrime, money laundering and asset forfeiture, organized crime and racketeering, violent crime, and child sexual exploitation, for which he received many commendations and awards. Brian served as the Violence Against Women Coordinator and Anti-Gang Coordinator in Los Angeles and led a federal organized crime task force.
After graduating law school, Brian clerked for former Chief Judge Gilbert S. Merritt of the U.S. Court of Appeals for the Sixth Circuit.
Brian is a frequent public speaker and commentator, including at conferences, lectures, and trainings, in news media coverage, and in published articles and client alerts. He has an active pro bono practice and is deeply involved in community service, including as a member of the Board of Advisors for Vanderbilt Law School, the Executive Committee of the Board of Directors for Teach Democracy (non-partisan nonprofit dedicated to advancing civics education and engagement among largely underserved youth), the Board of Governors for the Association of Business Trial Lawyers, and the Board of Directors of the SoCal Regional Subcommittee of the ABA’s White Collar Crime Committee, and as a fellow of the American Bar Foundation.
Brian earned his B.A. with distinction in general scholarship from the University of California at Berkeley and his J.D. from Vanderbilt Law School, where he was elected Order of the Coif.
