Career
Tony Chen is a partner at Jones Day Shanghai office. He has represented life science clients in complex cross-border intellectual property matters relating to China since 2004. Tony represents Chinese biotechnology clients building IP assets in the areas of small molecules, biologics, gene therapy, cell therapy, gene editing, AI-enabled drug discovery and RNA therapeutics. He supports clients in licensing and partnership transactions and advises investors on mitigating IP risks associated with investing in Chinese biotechnology companies. Tony advises pharmaceutical and biotechnology companies on navigating China's pharmaceutical patent linkage system for protecting new drugs. He assists clients with procuring patents suitable for Orange Book listings and patent term extension and is well-versed in defending innovators against patent invalidation challenges. Tony helps US and Chinese companies in complying with technology export control regulations in industries including semiconductor, lithium-ion battery, genetic resources, and artificial intelligence. Tony has worked with Jones Day's litigators in the United States and Europe in representing Chinese entrepreneurs and companies in litigation involving patent infringement, ITC 337 investigation, trade secret misappropriation, and economic espionage prosecution.
