Career
Joshua A. Whitehill is counsel in the firm’s Intellectual Property Litigation Practice Group. Josh has over 15 years of litigation experience, including in patent, trade secret, and contract disputes before federal, state, and appellate courts and in patent office and arbitration proceedings. Josh’s matters have involved a wide array of technologies, including pharmaceuticals, biologics, medical devices, vaccines, gene-editing technologies, and other chemical compounds and compositions, as well as integrated circuit, mobile payment, routing, telecommunication, and lighting technologies.
Josh has focused a considerable part of his practice on counseling life science companies on intellectual property matters in the areas of pharmaceuticals and biotechnology. Josh has significant experience in generic drug litigation under the Hatch-Waxman Act and biosimilar litigation under the Biologics Price Competition and Innovation Act (BPCIA). Such matters have concerned medicines for oncology, immunology, gastroenterology, HIV, diabetes, cardiovascular disorders, men’s health, and women’s health, among others. Josh has advised numerous pharmaceutical companies on patent validity, infringement, and enforceability, pre-litigation strategy, patent and market landscapes, freedom to operate, and risk assessment and mitigation strategies.
Josh’s pro bono activities include representing clients in administrative proceedings related to veteran benefits, naturalization, VAWA status, and permanent residency status, and organizing legal clinics for small businesses in underserved communities.
