Tom practises in all areas of employment and industrial law, and is a trusted advisor for employers facing challenging industrial relations issues. He has particular expertise in employment litigation and strategy, including acting in complex breach of contract, post-employment restraint, unfair dismissal, general protections and discrimination claims.

In addition to specific expertise in employment litigation and industrial relations, Tom works with clients to manage day-to-day workplace matters, discrimination, harassment and bullying issues and conducts training and compliance reviews.  Further, he has substantial experience in assisting employers to manage workplace change, including redundancy issues.

Tom’s broad expertise includes advising on the employment aspects of corporate transactions of all sizes and complex transfer of business issues.  He regularly advises on employee separations, including in relation to senior executives.

Examples of Tom’s experience include acting for:

various employers, including in the construction, transport and retail industries, in relation to enterprise bargaining related matters including obtaining orders in the Fair Work Commission in relation to good faith bargaining and to stop industrial action. numerous employers in post-employment restraint matters, including in proceedings commenced in the Supreme Court of Victoria and the Supreme Court of New South Wales. major insurers, advising in relation to numerous employment disputes, unfair dismissal, adverse action and discrimination claims. major banks in a number of complex general protections, unfair dismissal, and post-employment restraint matters. an emergency services organisation in the first intractable bargaining declaration application under the intractable bargaining regime in the Fair Work Act 2009 (Cth), including before the Full Bench of the Fair Work Commission and a Full Court of the Federal Court of Australia. employers in the health industry, including in relation to underpayment issues and industrial disputes involving consultation obligations.

Tom is an accomplished presenter and regularly speaks at external conferences and hosts seminars on key issues in employment and industrial law.
