Koen Rutten

Koen Rutten (1975) is a founding partner of Finch Dispute Resolution. He specializes in corporate, financial, and commercial dispute resolution. He specializes in company-law disputes, liability proceedings and corporate governance issues. He represents the interests of companies, shareholders, directors and officers, and supervisory directors. Koen also handles Post M&A disputes and inquiry proceedings at the Enterprise Chambers. He also litigates and advises on the Dutch Financial Supervision Act and the liability of financial institutions and supervisory authorities. Koen represents the interest of individuals, but also, he represents clients in class actions and bundled claims He has successfully handled multiple cases on behalf of investors and other victims of misconduct. Koen is the President of the Association for Mass Claims Litigators.
Maarten Mussche

Maarten Mussche

Maarten Mussche (1982) is a founding partner of Finch Dispute Resolution. He specializes in corporate and commercial law. He has extensive litigation experience, in-depth  knowledge of procedural law and is a skilled negotiator. Maarten handles cases involving shareholder conflicts, breach of business contracts, acquisition-related disputes, directors’ liability and enforcement claims. He advises companies, shareholders, directors and professionals in cases involving potential liability situations. He regularly represents clients in exit proceedings and inquiry proceedings before the Enterprise Chamber of the Court of Appeals in Amsterdam. Maarten holds a PhD (2011) at the Erasmus University Rotterdam on his thesis regarding directors’ liability. He is an editor of the monthly academic journal Maandblad voor Ondernemingsrecht since its launch (2015). Maarten frequently publishes and lectures in the field of corporate and commercial law.

Dieuwertje de Leeuw

Dieuwertje de Leeuw (1983) is a founding partner of Finch Dispute Resolution. Dieuwertje is a commercial litigator with a focus on corporate and contractual disputes. She handles a wide variety of post-M&A disputes, shareholder disputes, directors’ and officers’ liability cases and disputes relating to commercial contracts, including the termination of contracts and negotiations. She is a specialist in the areas of attachments, execution of assets and enforcement of judgments, and has garnered a wide range of experience in relation to disputes in the financial sector. Dieuwertje publishes and lectures on a regular basis. She is on the editorial board of the corporate law journal Bedrijfsjuridische Berichten (Bb) and acts as a guest lecturer at the Vrije Universiteit in a postgraduate legal program on corporate litigation.

Deals

    • Representing institutional investors on a claim for damages against Steinhoff and its auditor for not carrying out its duty of care (EUR 700 million).
    • Acting as lead lawyer on behalf of a capital fund in a claim for damages for breach of contract.
    • Advising a large group of institutional investors on a claim against a financial institution regarding losses resulting from international corruption and money laundering (EUR 1.4 billion).
    • Litigating for a group of clients who bought trucks from truck manufacturers involved in a long-running cartel.
    • Acting on behalf of institutional investors against a listed company in connection with the recall of defective products (EUR 700 million).
    • Litigating for plaintiff in a complex breach of contract case against Capgemini regarding the development of software.
    • Advising institutional investors on a claim for damages worth EUR 1.4 billion.
    • Acting for Upper Brook in a large number of connected cases involving Libyan, UN and EU sanction law and international asset tracing.
    • Representing former directors of Estro against mismanagement claims in connection with a EUR 500 million LBO.
    • Advising EIG Management on investment matters related to misinformation about the issuance of shares in Petrobras’s financing company.
    • Litigating for various domestic and international shareholders and in enquiry proceedings before the Enterprise Chamber.
    • Representing an investment fund in a complex, multimillion euro post M&A-dispute.
