Diego Agüeros Jiménez is a trusted legal advisor to domestic and multinational companies on complex workplace disputes and regulatory challenges. He works closely with executives and in-house legal teams to provide strategic guidance that helps employers mitigate risk, ensure compliance, and make informed workforce decisions. An experienced labor and employment attorney, Diego represents corporate clients in all aspects of employment law, blending deep litigation experience with practical, business-focused counsel. 

Diego represents employers in employment and labor litigation before federal and state trial and appellate courts, as well as administrative agencies. His experience includes matters involving non-compete and restrictive covenant disputes; discrimination and retaliation claims under Title VII, the ADEA, and the ADA; wage and hour claims under the FLSA; employee benefits and leave matters under the FMLA, ERISA, COBRA, and USERRA; class and collective actions; and employment-related contract and tort claims. His practice also includes extensive litigation experience under Puerto Rico law, including the Unjust Dismissal Act, Workmen’s Compensation Act, Anti-Reprisal Statute, Government Ethics Act, and civil rights statutes. 

In addition to litigation, Diego has significant experience representing employers before administrative agencies, including the Equal Employment Opportunity Commission (EEOC), Department of Labor (DOL), Puerto Rico Department of Consumer Affairs (DACO), and the State Insurance Fund. This work includes agency investigations, hearings, enforcement actions, and compliance matters, as well as the development of coordinated litigation and regulatory strategies. Diego manages cases from initial filing through trial and final judgment on appeal. 

Diego also advises employers on labor relations matters, including the negotiation of Collective Bargaining Agreements and counseling on concerted activities, grievance procedures, and union-related issues. This experience is complemented by day-to-day employment counseling focused on wages and benefits, corrective and disciplinary actions, reductions in force, internal investigations, crisis management, employee privacy, employee assistance programs, settlement negotiations, and employment terminations. 

He takes a proactive approach to risk management and compliance, ensuring employers meet legal requirements while minimizing exposure. A significant portion of his practice is devoted to designing and drafting employee handbooks, workplace policies, and employment agreements, as well as developing compliance strategies for statutory and administrative requirements such as Workmen’s Compensation, SINOT, Chauffeur’s Social Insurance, and Unemployment Insurance.

Diego maintains direct and ongoing contact with clients, serving as a strategic advisor to executives and in-house teams. He helps clients stay informed and make sound decisions by providing clear status updates, drafting auditor’s letters, managing litigation budgets and billing, negotiating legal services agreements, and ensuring legal strategies align with business objectives. Through this hands-on approach, Diego builds long-term client relationships grounded in responsiveness, transparency, and trust.
