Swarajit Dey has over 16 years of experience in Litigation, Arbitration, Property Disputes, Corporate Laws, Environmental Laws, Admiralty Laws. He primarily appears before the Hon’ble High Court at Calcutta and various Tribunals including Arbitral Tribunal, District Courts, Commercial Courts in the State of West Bengal. He has dealt with several admiralty suits for and/or against ship owners / P&I Clubs. He has represented one of the parties in a foreign arbitration where seat was in London. Prior to AQUILAW, he was engaged with M/s. Bose & Mitra, Solicitors & Advocates. He has completed his LLB from the University of Calcutta in 2009 and is a member of the Bar Association, High Court at Calcutta.

WORK EXPERIENCE

INTERNATIONAL ARBITRATION

Appeared and advised a respondent in a foreign arbitration involving maritime dispute.  Appears and advises Award Holders of intentional arbitrations in enforcement proceedings in India.

DOMESTIC ARBITRATION

Appears and advises several public sector undertakings in arbitration proceedings defending claims and also making counter claims.  Appears and advises private organizations in arbitration proceedings as claimant or respondent. He has handled arbitrations and disputes arising out of Construction/Infrastructure contracts

SUITS, WRITS, APPEALS AND OTHER COURT PROCEEDINGS

Advises and represents Clients in admiralty suits, money suits, suit for damages, suit for defamation, Title suits, suit for trade mark infringement, copyright etc. before High Court at Calcutta, District Courts, Commercial Courts.   Advises and represents various Clients in Writs under Article 226 of the Constitution of India, Appeals before High Court at Calcutta, District Courts, Commercial Courts and Supreme Court of India.  Also advises and represents various Clients before High Court at Calcutta, District Courts, Commercial Courts under several provisions of the Arbitration & Conciliation Act, 1996, Indian Succession Act, 1925 etc.

TRIBUNALS

Advises and represents several project proponents before National Green Tribunal, Kolkata.  Advises and represents various Clients before Debt Recovery Tribunal. Advises and represents operational creditors, corporate debtors before National Company Law Tribunal, Kolkata.

MARITIME LAW

Represented importers/exporters in admiralty suits having maritime claims seeking arrest of ships within the territorial waters of India. Represented ship owners in admiralty suits for release of ships by securing the claim and taking steps for vacating the order of arrest in appropriate cases. Appeared for the crew of a vessel which was abandoned by its owner after the vessel was arrested and took all steps to ensure that the crew received their unpaid wages from the sale proceeds lying with the jurisdictional court pursuant to the sale of the ship.
