Adam supports individuals and businesses on a wide range of disputes, always looking for practical solutions before going to court

Adam Gardiner is a Senior Associate in our Dispute Resolution and Litigation team. He acts for both pursuers and defenders on a wide range of areas and frequently appears in the Sheriff Court and Court of Session.

His experience includes commercial litigation, debt recovery, boundary disputes and access disputes, commercial leases and irritancy, professional negligence, title conditions, executry disputes, ownership disputes and actions for division and sale, and guardianship applications or other applications relating to the Adults with Incapacity (Scotland) Act 2000.

He regularly advises landlords, tenants and letting agents on issues and disputes about Private Residential Tenancies, often appearing at the First-tier Tribunal in relation to eviction applications and civil applications.

Adam always looks for practical outcomes for clients. Whenever possible, he seeks to resolve disputes without court action, making use of mediation and arbitration opportunities instead.

Highlights

• Appearing in the First-tier Tribunal (Housing and Property Chamber) to successfully pursue the first eviction order for Private Residential Tenancies based on the ground that the landlord intended to renovate the property.

• Representing clients in mediation sessions regarding property disputes as well as complex Court of Session proceedings.

• Successfully opposing an application to the Lands Tribunal for Scotland for a variation to a route of access that would have significantly restricted the client’s ability to access their property.

• Appearing at urgent interim interdict hearings in the Sheriff Court to protect clients’ property from potential damage by their neighbours.
