Dispute Resolution

Position

Richard’s practice comprises all aspects of commercial dispute resolution, in which he provides reliable, strategic advice to businesses, professionals, and private clients. Whilst prepared to litigate disputes to trial if needed, he is a strong advocate for resolution of complex matters using alternative dispute resolution including mediation.

Richard leads the firms contentious trusts and probate sub-group and is a member of the Northern Contentious Probate Group and the Contentious Trusts Association.

He often collaborates with the firm’s tax and probate team using his experience and expertise to guide litigation strategy on a wide range of complex contentious trust and probate disputes including those involving:

  • The interpretation of wills of trusts;

  • Challenges to the validity of wills and trusts (often on grounds of lack of capacity and/or undue influence);

  • Proceedings to remove trustees or executors;

  • Claims for reasonable financial provision under the Inheritance (Provision for Family and Dependants) Act 1975; and

  • Multi-jurisdictional trust and probate disputes.

Richard also regularly advises on High Court litigation involving shareholder, partnership and boardroom disputes.

Clients value Richard for understanding their objectives and delivering robust, practical guidance.
