Bart De Moor

Bart De Moor is a partner in our dispute resolution practice and in the restructuring & insolvency practice. He assists and advises clients on litigation and alternative dispute resolution, company law, commercial law, private international law, and secured debt, whether they are complex international issues or local matters. A lot of his work revolve around corporate disputes such as shareholders and directors’ disputes, directors’ liability, and insolvency-related disputes. He also advises clients on reorganisation and insolvency and is regularly appointed by the court as an insolvency practitioner. He was an insolvency practitioner appointed by the court in the reorganisation proceedings of the Belgian airline Sabena, the companies Photo Hall Multimedia and Flamant Group, and in the bankruptcy proceedings of Photo Hall Multimedia and Free Record Shop. Bart is an accredited mediator in civil and commercial matters, accredited with the Federale Bemiddelingscommissie since 2007. He is an insolvency practitioner, who is admitted to plead before the Brussels Court of Enterprises (Ondernemingsrechtbank/Tribunal de l’entreprise). Bart is a lecturer at the Faculty of Law of Katholieke Universiteit Leuven (KU Leuven) and author of numerous books and articles published extensively in legal journals. He is a member of the editorial board of the the legal journal DAOR (Droit des Affaires-OndernemingsRecht), member of Insol Europe and Insol World, and member and co-chair of the Reorganisation and Workouts Subcommittee of the Insolvency Section of the International Bar Association (IBA).

Frédéric Heremans is a partner in our Banking & Finance practice. Frédéric is an expert in banking and finance and advises major international and domestic banks and international groups on domestic and cross-border financing transactions, including syndicated loans, acquisition finance, real estate finance, project finance, structured finance, and securitisation. He also has relevant experience in mergers & acquisitions, including share and asset deals, private equity, restructuring and reorganisations, and shareholders agreements. Frédéric is highly valued for his expertise, his knowledge and his pragmatic, deal-oriented approach by market players in Belgium and abroad. He is, amongst others, ranked as “Leading lawyer - highly regarded in Belgium” by IFLR1000 and is recommended in Legal 500. He is the author of various articles in the field of banking and finance.

Team Services

Our Restructuring and Insolvency team advises clients on the full range of matters relating to restructuring and insolvency. The team has unique expertise in advising clients and regularly accepting appointments as office holders, administrators or liquidators. We are also instructed by foreign office holders and law firms to handle cross-border proceedings and disputes.

Our unique combined experience as an advisor to creditors and as an office holder provides us with precious know-how in these types of matters. In this respect, we have built up specific expertise in litigation on directors’ liability, in addition to our strength in general litigation and alternative dispute resolution in these subject matters.

When representing creditors, we seek the timely and efficient enforcement of security interests. We avoid increasing credit exposure for a distressed debtor and avoid relative deteriorations for other creditors during formal insolvency proceedings. We help clients to reduce loss caused by a debtor’s winding-up or other insolvency proceedings. Having experience as an office holder allows us to anticipate actions that a debtor would take during insolvency proceedings. We combine our restructuring and insolvency expertise with knowledge from our other lawyers who specialise in Corporate/M&A, Finance, Tax and Employment law.
