I advise and represent international clients across a diverse range of disputes, including corporate and commercial litigation, investment disputes, regulatory investigations, enforcement actions, data and cybersecurity issues, consumer complaints and employment claims.
Case highlights:
Acted in the first race discrimination claim in Hong Kong and successfully struck out the claim summarily despite the extremely high threshold to do so against a litigant in person.
Acted for a telecommunications operator in a trademark infringement litigation which set Hong Kong’s first case precedent on comparative advertising.
Acted for a group of corporate defendants in multi-jurisdictional proceedings involving fraud, breach of fiduciary duty and breach of trust claims in parallel proceedings including at the Hong Kong Court of Final Appeal and the Privy Council of UK.
Acted for an ultra-high net worth owner of a real estate enterprise in his successful defence of a 10-year multi-party dispute arising from the enforcement of a CIETAC arbitral award involving PRC land development contracts. Decisions handed down at different court levels including the Court of Final Appeal are often cited in leading text and authorities.
Acted in the first enforcement proceedings commenced by the Hong Kong Competition Commission, which set important precedents for subsequent enforcement proceedings at the Competition Tribunal, including the use of confidentiality rings, the applicability of the hearsay rule, the standard and scope of the Commissioner’s discovery obligations, public interest immunity, and the standard of proof applicable to Competition Tribunal proceedings.
My regulatory experience includes advising clients in inquiries and investigations conducted by the Competition Commission, the Communications Authority, the Independent Commission Against Corruption, the Securities and Futures Commission, the Stock Exchange of Hong Kong, the Hong Kong Monetary Authority, the Customs and Excise Department, the Equal Opportunities Commission and the Office of the Privacy Commissioner for Personal Data in Hong Kong, the Monetary Authority of Singapore, the European Securities and Markets Authority in Europe and the Financial Conduct Authority in United Kingdom.
I assist businesses handle a full spectrum of compliance and risk management issues in a variety of sectors including asset management, real estate, automotive and financial services, with specialist experience in luxury and retail, technology, telecoms and crypto industries.
Among the earliest to qualify as a solicitor advocate in 2015, I have full rights of audience to appear before all levels of Hong Kong courts as an advocate in civil proceedings.
