Position
Marlena Koscielniak, lawyer at BUREN, specialises in insolvency law and corporate law. Her daily practice includes advising companies facing financial difficulties and assisting creditors in recovering their claims. In addition, she advises entrepreneurs on a variety of corporate law matters, including directors' liability, contractual disputes, and (re)financing and securities (mortgage, pledge, guarantee, etc.). Marlena is also frequently appointed by the court to act as a trustee in bankruptcy cases.
Since 2014, Marlena has been active in the field of insolvencies, regularly serving as a (deputy) trustee. Her experience as a trustee enables her to effectively advise businesses in financial distress and their directors. She is quick to identify red flags and is often deeply involved in the operational aspects of companies as a trustee. This hands-on experience allows her to approach legal issues with a broader, entrepreneurial perspective. Marlena is characterised by her pragmatic approach, always prioritising the commercial interests of the entrepreneur.

Education
After completing the European Law School programme at Maastricht University, Marlena obtained a master’s degree in Commercial Legal Practice from the University of Amsterdam. She also pursued studies in ‘Corporate Law and Governance’ and ‘Competition Law and Policy: Controlling Private Power’ at the London School of Economics. In 2021, Marlena successfully completed the INSOLAD/Grotius specialist course in Insolvency Law, and in 2023, she completed the specialist course in Financial Economics for Insolvency Lawyers at Erasmus University.
