Banking and Financial Disputes

Acting for four international lenders in High Court Commercial Court proceedings concerning a US$133 million claim arising from a syndicated lending facility to companies connected with the Essar Group, part of a wider lending structure of approximately US$250 million, involving guarantor entities incorporated in the Cayman Islands, the United Arab Emirates and Cyprus. Advising international banks with UK exposure, including State Bank of India, Bank of India, ICICI Bank UK, Punjab National Bank, India Infrastructure Finance Corporation, Canara Bank, Syndicate Bank and Union Bank of India, on various claims, enforcement strategies relating to defaulted lending facilities, including disputes involving borrower structures, defendants and assets spanning the UK, India, Europe, USA, Middle East and Africa.

Insolvency and Restructuring Litigation

Advising in relation to the insolvency of Life & Style Retail Limited, a retail chain with over 150 stores, including disputes concerning creditor claims and administration issues involving retail operations across the UK. Acting in the bankruptcy proceedings of Subhash Kanji Thakrar, involving complex creditor disputes, in protracted litigation involving almost 20 parties, and asset recovery strategies concerning over 220 property assets.

Fraud, Asset Recovery and Enforcement

Acting for investors to recover funds invested through brokers into property investments with opaque structures and security and the hallmarks of Ponzi schemes. Acting for the prosecutor of a private criminal prosecution which concluded in a six-month trial.

Commercial and Trust Disputes

Acting for the English subsidiary of the MMG Group in a £25 million High Court property dispute involving complex contractual interpretation, valuation evidence and cross-border corporate structures. Acting in a dispute between a contractor to the Government of the United Arab Emirates and an English subcontractor concerning claims for damages, contractual performance issues and quantum meruit payments relating to infrastructure works in the UAE. Acting for American shareholders in a shareholder’s dispute with English shareholders pertaining to investment properties and hotels based in the Turks & Caicos Islands.
