'Highly recommended' by clients, Dorda Rechtsanwalte GmbH's 'outstanding' team is 'extremely knowledgeable, dedicated and perfectly organised'. It is led by 'top-notch expert and mastermind' Axel Anderl, who 'always goes the extra mile and never loses sight of any risks', and is praised for its 'extensive industry knowledge and impressive track record' covering the full spectrum of TMT work. Anderl recently advised Erste Group and its subsidiary s IT Solutions AT Spardat on its largest outsourcing project, and assisted Kommunalkredit with its new online banking business and associated greenfield outsourcing project. With an extensive blue-chip client base, Cerha Hempel covers a wide range of TMT sector work with a particular focus on data protection, IT and telecoms law. The 'very responsive and pragmatic' team, which is led by the 'excellent' Hans Kristoferitsch, advises Spar on all data protection, data security and IT matters and also assists Asfinag on various IT, data protection and GDPR compliance issues including traffic and toll-collection data matters alongside video surveillance issues.

Advising on IT, data security, data protection and telecoms matters is a central pillar of Freshfields Bruckhaus Deringer's TMT practice, which predominately handles cross-border work and benefits from its strong M&A team when dealing with transactional matters. Bertram Burtscher's team is also frequently retained to assist with sector-related infrastructure projects. Principal associate Gernot Fritz is a key name for data protection matters.

IP and IT boutique GEISTWERT has data protection and IT work at its core and is adept at handling contentious and transactional matters. The team has been particularly active recently in advising clients, including Iqvia, the Austrian National Library (Österreichische Nationalbank) and Parfümerie Douglas, on the implementation of GDPR. Max Mosing and the 'brilliant' Juliane Messner, who has 'very strong problem-solving skills', also assisted Asfinag with data protection matters pertaining to its toll system. Höhne, In der Maur & Partner Rechtsanwälte GmbH & Co KG is highly regarded for its comprehensive media law expertise, including print and digital media, film and television, which makes it a popular choice for media companies, radio stations and journalists, but the team also handles IT and data protection matters including disputes. Thomas Höhne is a highly regarded media law expert and Markus Dörfler is the main contact for data protection work. Georg Streit is another key figure.

Regarded as the 'market leader in data protection', Knyrim Trieb Rechtsanwälte OG has significant expertise in the banking, pharmaceutical, retail, energy, manufacturing and automotive sectors. Its client roster includes the Austrian Chamber of Commerce, Lenzing and Kelag. The highly regarded Rainer Knyrim jointly heads the team with Gerald Trieb. Alexander Nessler and Tobias Tretzmüller were made counsel in 2018.

Wolf Theiss Rechtsanwalte GmbH & CoKG is well equipped to guide clients through contentious and non-contentious matters at the intersection of IT and IP and also handles data protection and media law matters. Roland Marko, who jointly heads the team with Georg Kresbach, advised Addiko Bank Group on the implementation of an internal data protection compliance system, and assisted T-Systems, a Deutsche Telekom subsidiary, with data collection and data protection matters. In the media sector, the team advised Sky on signal transmission agreement matters. Consultant Martin Tauber joined the team from an in-house role in January 2018.

andréewitch & partner rechtsanwalte GmbH is best known for its expertise in IT law, handling various contentious and non-contentious matters including data protection. Markus Andréewitch is the main contact.

Baker McKenzie • Diwok Hermann Petsche Rechtsanwälte LLP & Co KG provides 'pragmatic solutions' and is particularly active in the contentious sphere, acting for clients in IT and telecoms-related proceedings while also providing advice on data protection issues including GDPR and matters pertaining to computer hardware and software, social media, search engines and cloud computing. 'Very knowledgeable' senior associate Lukas Feiler heads the team, which includes senior associate Martina Grama.

Binder Grösswang's strength lies in dealing with IT contracts, outsourcings, e-commerce and data protection issues. Team head Ivo Rungg advised Springer Maschinenfabrik on a co-operation agreement for the development of a new IT system, and assisted Tiroler Glashütte with matters pertaining to its launch of a new online sale and distribution system. Tele2 Telecommunication retained the team to advise on IT outsourcing matters.

Eisenberger & Herzog has IT work at its core but also handles data protection matters. Together with its public procurement practice, Andreas Zellhofer's team advised Big Bundesimmobiliengesellschaft on the outsourcing of its data centre by way of a public tender. The team also handles various local counsel instructions for Microsoft and most recently advised the client on cloud computing services provided to Austrian customers alongside software licensing and service agreements. Lansky, Ganzger + Partner (LGP) has carved out a strong practice advising national media companies and publishers, internet providers and software companies, alongside individuals in the entertainment industry, on the whole spectrum of media law while also handling data protection work. The group advised Radio Energy on data protection matters and assisted longstanding client SchauTV with broadcasting contracts and various other media law matters.Gerald Ganzger  heads the team.

Schoenherr (Schönherr Rechtsanwälte)'s 'incredibly versatile and professional' newTech team is dedicated to IT work and regularly advises clients, including several insurance and banking sector players, on e-commerce, outsourcing and cloud services matters, while also handling data protection and fintech work. 'Responsive, solution-oriented and professional' team head Wolfgang Tichy assisted Uniqa Insurance Group with various contracts concerning the implementation of a new group-wide IT system. Handling contentious and non-contentious IT and data protection matters is a significant element of CMS' 'smart and responsive' TMT practice, which is led by Johannes Juranek.     Good things come to those who wait? Finally, the main implementing regulation for the Austrian Law on Network and Information System Security ( Netz- und Informationssystemsicherheitsgesetz , " NISG ") was published last week. It serves primarily to define which companies are actually affected by the NISG. Now it is getting serious for the operators of " essential services ". What does that mean?

    Black Friday is unquestionable one of the most profitable and busiest days of the year for retail, particularly online. Worldwide almost all online store do offer sales or special promotions on Black Friday or Cyber Monday. Already after this practice has established online, a trademark for " BLACK FRIDAY " was registered in Germany back in 2013. In 2016 a Chinese company acquired the trademark and then filed in 2017 for its extension to Austria. Based on the registered trademark, it granted exclusive rights to an Austrian company, which licensed usage rights to various partner stores against remuneration. Further, an exclusive " Black Friday-Cooperation Program " was established. Non-partners who used the event name or trademark were prosecuted and requested to either pay a license fee or refrain from running Black Friday promotions. Some followed the request and entered into license agreements. Some, however, did challenge the validity of the trademark. Finally, respective proceedings to check the actual protection of the trademark were initiated. Austrian courts now held that the trademark " BLACK FRIDAY " is not protected in Austria .

    On 5th December 2018, the Austrian data protection authority ( Datenschutzbehörde , "DSB") issued a decision (DSB-D123.270/0009-DSB/2018) on data subject's right to data deletion according to Art 17 GDPR. In a nutshell, the DSB accepted consistent anonymisation as a valid alternative to physical and technical deletion. Beside the clear statement that anonymous data is not subject to the GDPR, the DSB provided detailed information on (technical) requirements of anonymisation methods:

  • Consent or pay – a valid scheme under the GDPR?

    Media companies throughout Europe struggle with a difficult economic environment: Shrinking sales figures for print products, the digitalisation and consumer demand force publishers to offer their content also on the internet. However, generating money for online publications is not quite easy as – at least in Austria – online subscription against renumeration has not been well accepted by customers. This partially has its root in the lack of suitable micropayment means in the past and users thus getting acquainted to online information being offered for free. Thus, publishers have instead focused on financing their platforms by online marketing activities such as placement of banners. Nowadays such digital advertisement is usually targeted to the specific user. For this purpose, cookies are stored on the user's computer upon his first visit of the website, which then collect data about his location, technical equipment used and online behaviour. This finally allows to display specific, user targeted advertisements. However, such cookies may cause issues with applicable consent requirements under the telecommunication and data protection regulations:

The offer will implement the Memorandum of Understanding (MoU) concluded in May 2016 between the Austrian Minister of Finance and a significant number of creditors of debt instruments issued by HETA ASSET RESOLUTION AG (HETA) that are subject to a regional law deficiency guarantee.
